Then, five months after the cap year ends, a letter shows up from your Medicare Administrative Contractor. It says you owe money back. Sometimes a lot of money. And here's the part that stings: the payments you're refunding already went to payroll, rent, supplies, and medications months ago.
That's the Medicare aggregate cap. It isn't a penalty for bad care. It's a limit on total payments for the year, and by the time you find out you're over it, the money is already spent.
For hospices with a bookkeeper but no CFO, that timing gap is the whole problem. Nobody's job is to watch this number every month. So nobody does, until the letter arrives.
There's more hiding in the cap than most agencies realize. It isn't a per-patient limit, even though it looks like one. A hospice can have three patients on service for 700 days each and still be fine, if enough short-stay patients balance it out. Owners who think that patients make the wrong calls.
Your beneficiary count isn't your census, either. Two different counting methods, streamlined and proportional, can produce very different numbers for the same agency. Most small hospices don't know which one they're on.
And even if you pass the aggregate cap, you can still owe money on the inpatient cap. It's a separate 20 percent limit on GIP and respite days, and most trackers ignore it completely.
The Medicare Payment Advisory Commission has reported that about 18.6 percent of hospices exceeded the aggregate cap in 2020, up from 12.5 percent in 2015. That number has been climbing. If your referrals lean toward long, slow declines, dementia especially, you're carrying more of this risk than you may realize, even while giving excellent care.
Here's what changes when you catch it early instead of late. Picture an agency that's entered seven months of data: October through April. Thirty-eight beneficiaries. $1,690,000 in Medicare payments.
